Terms of Service

Welcome to MoveCall. These Terms of Service ("Terms") govern your use of our website and subscription services, including our AI voice assistant (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility & Accounts
- You must be at least 18 years old to use the Services.
- You agree to provide accurate registration information and keep it updated.
- You are responsible for all activities under your account and for safeguarding your credentials.
2. Subscriptions, Trials & Billing
- Paid plans are billed in advance on a recurring basis via Stripe at the rate and cadence shown at checkout.
- Taxes may be charged as required by law. Price changes will be communicated where required and take effect on the next billing cycle.
- If offered, trials convert to paid at the end of the trial period unless you cancel beforehand.
- You can cancel at any time, but payments are non-refundable except where required by law or expressly stated by us.
3. Acceptable Use
- No illegal, harmful, discriminatory, or infringing activities.
- No reverse engineering, scraping, or probing the Service.
- No attempts to bypass security or rate limits.
- No use that violates call recording or consent laws.
4. AI Voice Assistant
- You are solely responsible for obtaining any required consent from call participants and for complying with applicable telemarketing, call recording, and privacy laws.
- We may process audio, transcripts, and metadata to deliver and improve this feature. We do not use your audio to train public models without permission.
5. Third-Party Services
The Services integrate with third parties such as Stripe (payments), Supabase (data/auth), and Vercel (hosting). Your use of third-party services may be subject to their terms and privacy policies.
6. Intellectual Property
The Services, including software, designs, text, graphics, and logos, are owned by MoveCall or its licensors and protected by law. Except as expressly permitted, you may not copy, modify, or create derivative works of the Services.
7. Customer Content
You retain ownership of content you submit to the Services (e.g., data you upload, call content). You grant us a limited, non-exclusive license to host, process, and display such content solely to provide and improve the Services, subject to our Privacy Policy.
8. Feedback
If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.
9. Confidentiality
Each party may access the other's confidential information. The receiving party will use the same care it uses to protect its own confidential information, and only for purposes of the relationship.

Our collection and use of personal data is described in our Privacy Policy.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THAT PERIOD.
13. Indemnification
You will indemnify and hold MoveCall harmless from claims arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.
14. Suspension & Termination
We may suspend or terminate your access for violation of these Terms or risk to the Services. You may cancel at any time via your account settings; upon termination, your right to access the Services ceases.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction where MoveCall is established, without regard to conflict-of-law principles. Courts in that jurisdiction will have exclusive jurisdiction, unless otherwise required by law.
16. Changes to These Terms
We may modify these Terms from time to time. Material changes will be communicated by posting an updated version and/or notifying you via the Services or email. Continued use after changes constitutes acceptance.
17. Miscellaneous
- These Terms constitute the entire agreement between us.
- If any provision is unenforceable, the remainder remains in effect.
- You may not assign these Terms without our consent.
- Failure to enforce a provision is not a waiver.
- Force majeure: we are not liable for events beyond our control.
